Alpinistas Star Rewards Terms & Conditions of Participation (“Terms”)

Members of the Alpinistas Star Rewards Program (“Program”) earn Points for buying merchandise on-line at www.thealpinistas.com (“Website”) as well as for taking part in certain other activities.

Members will earn 5 points, also called stars, for every $1 spent on the Website.  Points are awarded for full-priced orders only.  Discounts, shipping, tax, gift wrapping, gift cards, promo codes, coupons, sale items, final sale items, Re-Cover by Alpinistas purchases do not accrue points.  There may be other additional restrictions to earning rewards from time to time on specific inventory items but it will be made clear and announced within the product description.

Members can earn points for participating in other activities such as sharing on social media, birthday awards, referring friends or during special bonus promotions offered by Alpinistas.  These bonus point earnings may change without any prior notice.
Points are applied to the Member’s Program Account 14 days after purchase.  Returns will cause points to be adjusted appropriately in line with the item return value.  Points expire 12 months after they are awarded to the account.  There may be no notice or warning from Alpinistas of points expiring.

Program Tiers
There are three tiers in the Program:  Star Member, Rising Star and Summit Star.  Achieving Rising Star and Summit Star levels requires a certain level of spend or other point earning activity per year.  All membership tiers enjoy a variety of benefits offered by Alpinistas, subject to change, in their sole discretion, from time to time.  Benefits may vary by tier and some tiers may have more benefits than other, as determined by Alpinistas, in their sole discretion.

Star Member
All customers are automatically enrolled in the Program at Star Member level unless the minimum annual spend or point earning has been achieved to move to the higher elevation tier.

Rising Star
Rising Star is conferred to members who spend $300 on merchandise per 12 month term or achieve 300 points from earning activities.  This status is good for the remaining 12 month term and unless additional points are achieved before the end of the 12 month term, the member shall revert to Star Member Level.

Rising Star members shall receive one 25% off one full-priced item and one 20% off one full-priced item that will be awarded to use during special promotional periods, determined by Alpinistas.  Both the 25% off and 20% off coupons may have brand or category exclusions that prevent this coupon from being used on those excluded items.

Summit Star
Summit Star is conferred to members who spend $1300 on merchandise per 12 month term or achieve 1300 points from earning activities.  This status is good for the remaining 12 month term and unless additional points are achieved before the end of the 12 month term, the member shall revert to Star Member Level or Rising Star level, depending on their earning volume.

Summit Star members shall earn 2 points for every dollar spent and receive two 25% off full-priced items and two 20% off full-priced items that will be awarded to use during special promotional periods, determined by Alpinistas.  Both the 25% off and 20% off coupons may have brand or category exclusions that prevent this coupon from being used on those excluded items.

Summit Star members shall receive free shipping on all orders and free shipping on all returns as long as the return request is made within 30 days of order ship date.

 

Birthday Reward
Members may be awarded an additional benefit on their birthday.  To qualify for a birthday award, you must have joined the Program at least 30 days prior to your birthday and submitted your day of birth either at Program enrollment or on the membership page of your account, at least 30 days prior to your birthday.  Members are limited to one birthday offer per calendar year.

Redemption
Points can be redeemed for discount dollars or a discount percentage off future purchases as well as exchanged for various promotional items from time to time.  Discount rewards are not gift cards.  Discount rewards are provided by unique promotion codes.   Points will not be rounded up when redeeming for rewards.  Additional redemption options may be announced at a future point in time at the sole discretion of Alpinistas.
There is a minimum requirement of 250 points to redeem for a promotional reward..  There is no limit on the number of points that can be applied to each order.  When redeeming points for a dollar or percentage off of orders, there may be an order value requirement in place.  Rewards and points are not transferable and do not have any cash value, unless required by law.

Rising Star and Summit Star Members are eligible for a single-use 20% off coupon and 25% off coupon valid during certain limited promotional seasons during the year.  This offer will be announced at least 14 days prior to the start of this promotional season.  This offer may not be combined with any other discount or offer and is limited to in-stock, full-priced items.  Brand or product exclusions apply to the use of this coupon.  For example, the coupon cannot be applied to Rab, or Black Diamond Equipment, in addition to a number of other brands and this coupon cannot be applied to certain products such as tents or snowboards, in addition to other products, from time to time. If the brand is excluded from this promotion, the coupon will not apply at checkout.  

General Membership

The Alpinistas Star Rewards Program replaces the previous Membership Rewards Program.  All points earned before the Alpinistas Star Rewards Program have been rolled over in the new program.  Prior points will not apply to achieving elevation gifts and Rising Star and Summit Star discount awards. 

 

There is no membership or other fee to join the Alpinistas Star Rewards Program.  All customers are automatically enrolled into the Program upon their first purchase.  You may register for the Alpinistas Star Rewards Program on the Website before making a purchase via the Program page. Click the Join Now button to enter in your information.  The Program is available to legal residents of the United States who are 18 years or older.   
Your Alpinistas Star Rewards account will show your activity history, points earned, and available rewards. It is your sole responsibility to assure that your Program account information is current and otherwise accurate, updating such information, as necessary.  It is your sole responsibility to immediately inform us of any suspected unauthorized activity in your Program account.  Any dispute as to ownership of the Program account will be resolved by Alpinistas based on its determination of the authorized account holder’s email address.

The Program may be considered Financial Incentives under the California Consumer Privacy Act (“CCPA”). The Program Terms herein explain the Benefits offered to you under the Program, how to enroll and how to withdraw from the Program, and that you may withdraw at any time. In order to participate in the Program, we require certain identifiers such as name and email and if you choose to participate in the birthday program, your birth day and month.  The value of the rewards provided to you are in reasonable value to your personal information connected to the Program.

Alpinistas reserves the right to change the Program and these Terms, as applicable, at any time in its sole discretion.  In addition, Alpinistas reserves the right to cancel the Program at any time.  Alpinistas will take reasonable steps to provide notice via the Website or via e-mail notification to each Member in advance of such changes or Program cancellation taking effect.  However, due to an event beyond the reasonable control of Alpinistas (that is, a force majeure event, such as a riot, civil commotion, governmental action, natural disaster, pandemic/epidemic, materials shortage, act of fraud), Alpinistas reserves the right to have such changes take effect immediately, without liability of any kind under any legal opinion.

 

Your membership in the Program constitutes your agreement to such changes to the Program or the cancellation of the Program, if applicable.  Your participation in the Program is subject to Alpinistas’s Privacy Policy, which may be found at www.thalpinistas.com/privacy.  The Alpinistas’s Privacy Policy will explain how Alpinistas will collect, use and share your personal information in conjunction with the Program.  The conditions of Alpinistas’s Privacy Policy are made a part of these Terms and incorporated herein by reference.  In the event of any inconsistency between these Terms and Alpinistas’s Privacy Policy, Alpinistas’s Privacy Policy will prevail, govern and control. 

Upon joining the Program, you agree to receive email messages from Alpinistas from time to time relating to your participation in the Program.  These emails are referred to as “Transactional Emails''.  Alpinistas may also send you promotional emails with updates, offers and other information regarding Alpinistas outside of the Program. These emails are called “Promotional Emails''.  You may unsubscribe from receipt of Promotional Emails without affecting your participation in the Program. 

 

Release of Rights
To the fullest extent permitted by law, in becoming a Member and/or participating in the Program, you release and agree to hold harmless Alpinistas, LLC; and the directors, officers, agents, representatives, shareholders, employees, successors and assigns the above from any and all claims, damages, losses, liabilities, and other expenses (including attorneys’ fees) arising from or in any way related to participation in the Program under any legal opinion.

No Representation or Warranty
Alpinistas makes no representation, guarantee, or warranty of any kind regarding the Program, including the warranty or merchantability or the warranty of fitness for the intended purpose. The preceding excludes those warranties to which The Alpinistas is subject pursuant to applicable law.

 

General
The Program is void where prohibited by law.

 

The failure of Alpinistas to enforce any condition of these Terms in any circumstance shall not constitute the waiver of such condition. 

 

Dispute Resolution and Venue
Any and all disputes regarding the Program or these Terms shall be governed by the law of Nevada, county of Washoe.
Your recovery in any such action will be limited to your actual costs in participating in the Program (if any), with all rights to attorneys’ fees and any and all damages (including special, compensatory, punitive, consequential damages) as well as equitable relief being expressly waived. 
If the preceding or any other provision of these Terms is determined by the court to be invalid, illegal or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Alpinistas and is valid, legal and enforceable. Such determination of the invalidity/illegality/unenforceability of a given provision shall not affect the remainder of these Terms.
